Acceptable Use Policy
Rules and restrictions governing your use of the Aktok platform.

1. Overview
1.1 This Acceptable Use Policy ("AUP") defines the rules and restrictions that govern your use of the Aktok platform and related services (the "Service") provided by Aktok Inc, a corporation incorporated under the laws of Prince Edward Island, Canada ("Aktok," "we," "us," or "our").
1.2 This AUP is incorporated by reference into our Terms of Service ("Terms"). Capitalized terms not defined in this AUP have the meanings given to them in the Terms.
1.3 This AUP applies to all individuals and entities that access or use the Service, including:
- (a) Account holders and workspace administrators;
- (b) Workspace members and invited collaborators;
- (c) Users of Aktok-hosted websites, chatbots, and scheduling pages;
- (d) API consumers and third-party integrations accessing the Service programmatically; and
- (e) Any person who interacts with the Service on behalf of a customer or organization.
1.4 You are responsible for ensuring that your use of the Service -- and the use by anyone you invite, authorize, or enable to access the Service through your account or workspace -- complies with this AUP at all times.
1.5 Aktok reserves the right to determine, in its reasonable discretion, whether any activity or content violates this AUP.
2. Prohibited Activities
The following activities are prohibited when using the Service. This list is illustrative and not exhaustive; conduct that is similar in nature or effect to the examples listed below may also constitute a violation of this AUP.
2.1 Security Violations
You must not:
- (a) Attempt to gain unauthorized access to the Service, other users' accounts, workspaces, or any related systems or networks;
- (b) Probe, scan, or test the vulnerability of the Service or any related system or network, except with our prior written authorization as part of a coordinated security assessment;
- (c) Steal, harvest, or otherwise obtain credentials (including passwords, API keys, or authentication tokens) belonging to other users;
- (d) Share your account credentials with third parties or allow others to use your account (each user must have a separate account);
- (e) Circumvent, disable, or interfere with any security, authentication, or access control mechanisms of the Service; or
- (f) Intercept, monitor, or modify data in transit to or from the Service without authorization.
2.2 Abuse and Harassment
You must not use the Service to:
- (a) Harass, threaten, intimidate, bully, or abuse any individual or group;
- (b) Transmit hate speech, content that promotes violence, or content that discriminates based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age;
- (c) Impersonate any person, organization, or entity, or falsely state or misrepresent your affiliation with any person, organization, or entity;
- (d) Stalk, dox (publish private information about), or otherwise monitor any individual without their consent -- including through the use of CRM data, communication logs, or analytics tools within the Service; or
- (e) Engage in conduct that creates a hostile, intimidating, or offensive environment for other users.
2.3 Content Restrictions
You must not upload, store, transmit, or distribute through the Service:
- (a) Content that is unlawful, defamatory, obscene, or otherwise objectionable under applicable law;
- (b) Malware, viruses, worms, trojan horses, ransomware, spyware, or any other malicious or harmful code or files;
- (c) Content that infringes upon the intellectual property rights (including copyrights, trademarks, patents, and trade secrets) of any third party;
- (d) Content that violates the privacy or publicity rights of any third party; or
- (e) Regulated data -- including data subject to the Payment Card Industry Data Security Standard ("PCI DSS"), the Health Insurance Portability and Accountability Act ("HIPAA"), or comparable regulatory frameworks -- unless you have implemented all safeguards required by the applicable regulation and have obtained our prior written consent to store such data on the Service.
2.4 Communication Abuse
You must not use the Service to:
- (a) Send unsolicited bulk messages, spam, or chain communications through Aktok email, chat, or any other communication channel provided by the Service;
- (b) Send or facilitate phishing messages, social engineering attacks, or fraudulent communications using Aktok tools;
- (c) Send unsolicited commercial electronic messages in violation of Canada's Anti-Spam Legislation ("CASL"), the CAN-SPAM Act, the GDPR, or other applicable anti-spam or electronic communications laws;
- (d) Configure AI chatbots or automated communication tools to mislead end-users about the nature of the interaction (for example, by concealing that a response is AI-generated where disclosure is required by law or regulation); or
- (e) Use the scheduling, email, or chat features to engage in persistent, unwanted contact with individuals who have requested that you stop.
2.5 AI Agent Misuse
The Service includes AI-powered features, including AI agents, content generation, and automated workflow capabilities. You must not:
- (a) Use AI features to generate, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
- (b) Misrepresent AI-generated output as human-authored where applicable law, regulation, industry standards, or contractual obligations require disclosure of AI involvement;
- (c) Use AI features to make fully automated decisions that produce legal effects or similarly significant effects on individuals (such as credit decisions, employment decisions, or access to essential services) without meaningful human review and intervention;
- (d) Use the Service, its AI outputs, or any data obtained through the Service to systematically train, develop, or improve any machine learning or artificial intelligence model, system, or product that competes with the Service;
- (e) Attempt to circumvent, disable, or interfere with AI safety controls, content filters, or usage restrictions implemented by the Service or its underlying AI model providers;
- (f) Use AI features to generate deepfakes, synthetic media intended to deceive, or content designed to manipulate public opinion; or
- (g) Use AI features to facilitate any activity that would otherwise be prohibited under this AUP.
2.6 Technical Abuse
You must not:
- (a) Scrape, crawl, spider, or use any automated means to extract data from the Service, except through the Service's authorized APIs in accordance with applicable rate limits and documentation;
- (b) Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, or data structures of the Service;
- (c) Exceed, circumvent, or attempt to bypass API rate limits, usage quotas, or other technical restrictions imposed by the Service;
- (d) Interfere with, disrupt, or impose an unreasonable or disproportionate load on the Service's infrastructure, including through denial-of-service attacks, resource exhaustion, or deliberate overloading;
- (e) Use the Service's computing resources for cryptocurrency mining, proof-of-work calculations, or any other purpose unrelated to the Service's intended functionality;
- (f) Introduce or propagate software or code designed to interrupt, destroy, or limit the functionality of the Service or any connected systems;
- (g) Access the Service through unauthorized third-party applications or clients, except through authorized APIs and integrations;
- (h) Use enrichment features for mass data harvesting, list building, or any purpose unrelated to managing your legitimate business contacts within the Service; or
- (i) Resell, sublicense, redistribute, or otherwise make the Service available to third parties without our prior written consent.
2.7 Legal Violations
You must not use the Service to:
- (a) Violate any applicable local, provincial, national, or international law, regulation, or ordinance;
- (b) Facilitate, promote, or participate in illegal transactions, money laundering, financing of terrorism, or other financial crimes;
- (c) Violate export control or trade sanctions laws, including the Canadian Export and Import Permits Act, U.S. Export Administration Regulations ("EAR"), International Traffic in Arms Regulations ("ITAR"), or equivalent laws of other jurisdictions;
- (d) Provide the Service, or access to the Service, to any person, entity, or jurisdiction that is the target of comprehensive economic sanctions administered by Canada, the United States, the European Union, the United Kingdom, or the United Nations;
- (e) Infringe or misappropriate the intellectual property rights of any third party; or
- (f) Engage in any activity that would expose Aktok, its users, or its partners to legal liability.
3. Workspace Administrator Responsibilities
3.1 If you are a workspace administrator, you bear additional responsibilities under this AUP. You are responsible for:
- (a) Ensuring that all members and collaborators within your workspace are aware of and comply with this AUP and the Terms of Service;
- (b) Managing user roles, permissions, and data access within your workspace appropriately, including revoking access when it is no longer needed;
- (c) Promptly investigating and responding to reports of AUP violations within your workspace;
- (d) Ensuring that the data stored in your workspace -- including CRM records, files, and communications -- complies with applicable data protection and privacy laws, including informing individuals whose data you store and obtaining any required consents; and
- (e) Taking reasonable measures to prevent the misuse of AI features, communication tools, and integrations within your workspace.
3.2 Aktok may contact workspace administrators regarding suspected violations within their workspace and may require corrective action within a reasonable timeframe.
3.3 A workspace administrator's failure to address reported violations may result in enforcement action against the entire workspace, as described in Section 4.
4. Enforcement
4.1 Aktok reserves the right to investigate any suspected violation of this AUP and to take appropriate action. We may investigate on our own initiative or in response to reports received under Section 5.
4.2 Enforcement actions are proportional to the severity and nature of the violation and may include, in Aktok's reasonable discretion, any one or more of the following:

| 3 | Temporary Suspension | Suspension of access to some or all features of the Service for a defined period while the violation is investigated or remediated. |
| 4 | Permanent Termination | Termination of your account and/or workspace in accordance with the Terms of Service, Section 12 (Termination). |
4.3 For severe violations -- including those that pose an immediate risk to the security, integrity, or availability of the Service or the safety of users -- Aktok may bypass the escalation steps above and proceed directly to suspension or termination without prior warning.
4.4 Data Preservation During Disputes. Where an enforcement action is under appeal or dispute:
- (a) Your User Content will be preserved for a minimum of thirty (30) days from the date of the enforcement action, consistent with the data retrieval period described in the Terms of Service, Section 12.3;
- (b) During this period, you may request export of your User Content using the platform's data export features (where access permits); and
- (c) After the preservation period, we may permanently delete your data in accordance with our standard data retention practices.
4.5 Appeal Process. If you believe an enforcement action was taken in error:
- (a) You may submit an appeal by emailing legal@aktok.com within fourteen (14) days of receiving notice of the enforcement action;
- (b) Your appeal should include a description of the enforcement action, an explanation of why you believe the action was taken in error, and any supporting evidence;
- (c) We will review your appeal and respond within thirty (30) days of receipt; and
- (d) During the appeal review, the enforcement action will remain in effect unless we determine otherwise.
4.6 Law Enforcement. We may report violations of this AUP to law enforcement authorities where we believe, in good faith, that such reporting is required or appropriate.
5. Reporting Violations
5.1 If you become aware of any activity that you believe violates this AUP, we encourage you to report it promptly.
5.2 You may report violations by:
- (a) Email: Send a detailed description of the suspected violation to legal@aktok.com, including any relevant evidence (such as screenshots, URLs, or user identifiers); or
- (b) In-app reporting: When available, use the reporting features within the Service to flag content or behavior for review.
5.3 We will make reasonable efforts to acknowledge receipt of your report within five (5) business days and to investigate and respond within a reasonable timeframe.
5.4 Aktok will not retaliate against any user who makes a good-faith report of a suspected violation.
6. Changes to This Policy
6.1 We reserve the right to update this AUP from time to time. When we make changes, we will update the "Last Updated" date at the top of this document.
6.2 Material Changes. For material changes to this AUP, we will provide at least thirty (30) days' advance notice through one or more of the following methods:
- (a) Email notification to the address associated with your account;
- (b) In-app notification within the Service; or
- (c) A prominent notice on our website.
6.3 Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised AUP. If you do not agree to the revised AUP, you must stop using the Service before the changes take effect.
6.4 Non-Material Changes. Non-material changes (such as corrections of typographical errors or clarifications that do not affect your rights or obligations) may take effect immediately upon posting, without advance notice.
